DUI

A DUI charge brings much uncertainty. Where do I turn? Do I need an attorney? How do I choose an attorney? We know it is confusing and you likely have little to no experience on what to do. Maybe you have asked family and friends for their opinion, and if so, you likely received so many opinions that it makes the decision even harder. Well, at The Sellers Law Firm, let us give you some information to help to make the decision easier.

A DUI charge (driving under the influence) can have harsh and severe consequences. A DUI does not have to be based on alcohol consumption, but it can be based on the consumption of drugs which impair the ability to drive. These drugs do not have to be illegal drugs, but can be prescription medication. The DUI can also be based on a combination of drugs and alcohol. A conviction will result in the loss of your driver’s license, costs, fines and possible jail time. Under Alabama law, your first DUI conviction can result in:

  • Imprisonment of up to one year
  • Suspension of your driver’s license for 90 days
  • Fines between $600 and $2,100
  • Must complete court referral program.
  • Convictions stay on your driving record for 5 years

Having a prior DUI and being charged for a second or third time can have even greater consequences. Also, if you receive a fourth DUI within 5 years, it is a felony and you could be imprisoned from up to one year and one day to ten years! For example, a second DUI within 5 years carries the following punishment

  • Imprisonment from 48 hours to 1 year and not less than 70 hours of community service
  • Fines between $1000 to $5000
  • Loss of license for 1 year
  • Must complete court referral program
  • Convictions stay on your driving record for 5 years

A third DUI within 5 years carries the following punishment

  • Imprisonment between 60 days to 1 year
  • Loss of license for 3 years
  • Must complete court referral program
  • Fines between $2000 and $10,000
  • (Other punishment as stated above)

Alabama has a point system in place which is designed to keep up with the points assigned to individual drivers for different violations. This system helps determine the length of a license suspension period and is also used to punish drivers who continue to break the law while operating on Alabama’s roadways.

I would like to start out by saying Brandon sellers is more than a lawyer that has helped my family out in numerous occasions but he's also a great friend to our family. Whenever he can't find a resolution for the problem he always recommends somebody that can. I've known him for years grew up together always been really good friends. I like to say in closing I'm really glad I know him I'm glad he's been able to help us when we've needed him. Thanks for everything you've done. Timothy Palmer
